Job Description

Under the direction of the Health Care Facility Enforcement Director for the Health Facilities, with considerable latitude for the use of initiative and independent judgment. The Nurse III performs complex consultative services and technical assistance work for the Health Care Facility Enforcement Unit. Knowledge of nursing principles, acceptable professional standards of patient care; complex disease processes and treatments for pediatrics, adults and geriatrics. Applies analytical and critical thinking skills in the review of state licensing violations to ensure accuracy pursuant to state rules and regulations for the Health Facility Programs. Enforces cases in accordance with the laws and regulations pertinent to each health facility type. Consults with licensees, Commission staff, attorneys, managers, and outside regulatory authorities, as necessary, on matters relating to enforcement. Operates Commission database to accomplish data entry, reporting, case tracking, trending of data, and quality control. Facilitates meetings with Commission staff, managers, attorneys, licensees, or other members of the regulated community. Performs quality management of assignments including proofing, follow-up and tracking. Provides technical assistance on matters related to enforcement. May testify in hearings at the State Office of Administrative Hearings (SOAH) and in district court.

Essential Job Functions

Attends work on a regular and predictable schedule in accordance with agency leave policy.

(25%) Performs complex consultative services and technical assistance work for the Health Facility Programs. Enforces cases in accordance with the laws and regulations pertinent to each health facility type. Receives and reviews investigations, inspections, and statement of deficiency report referrals referred to Enforcement for enforcement action to ensure the referrals are complete and accurate. Examines deficiencies described in the report and the underlying evidence, interprets and applies appropriate sections of law and rule to determine if violations should be pursued or if additional case information is needed. Writes Notice of Violation (NOV) letters, which are written clearly so the respondent understands the allegations and options for resolving or contesting the case, in accordance with the Administrative Procedures Act (APA). Writes orders that memorialize the details of case resolution, including facts, violations, terms of settlement, other matters related to law and the case. Writes other documents, including but not limited to memoranda's, reports, presentations, letters, and emails. Processes multiple cases efficiently using good case management techniques. Manages multiple assignments with competing priorities. Accomplishes the above through working independently, or on committees, teams, workgroups, or various combinations thereof, as necessary to complete assignments and comply with the standard enforcement protocol.

(25%) Facilitates meetings with Commission staff, managers, attorneys, licensees or other members of the regulated community. Facilitates the Enforcement Review Committee (ERC) where cases are discussed, and consensus decisions are reached on the legal sufficiency of cases and the appropriate penalties to propose. Organizes, schedules, and conducts informal conferences with the respondent and attorney, with attendance by program staff, the program attorneys, and Commission managers to seek agreement for resolving the cases informally, in accordance with the APA. Arranges for formal hearings at State Office of Administrative Hearings (SOAH)
